Terms & Conditions

1. Introduction

These terms and conditions govern the provision of rope access, structural repair, and related services by Forth Rope Access Scotland (“we”, “us”, “our”) to our clients. By instructing us to undertake work, you agree to be bound by these terms.

2. Quotations & Pricing

All quotations are valid for 30 days unless otherwise stated. Quotations are based on the information provided at the time of quotation. Should the scope of work change, or if unforeseen conditions are discovered, we reserve the right to revise the quotation.

Fixed-price quotations cover the work described. Day-rate quotations are based on an 8-hour working day. Overtime, weekend work, and offshore mobilisation are subject to additional charges agreed in advance.

3. Payment Terms

For domestic work under £5,000: 50% deposit on acceptance of quotation, balance due on completion.

For work over £5,000: 50% deposit, 40% on completion of agreed milestones, 10% on final sign-off.

Payment is due within 14 days of invoice. Late payments may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

4. Cancellation

Cancellations made more than 7 days before the scheduled start date will receive a full refund of any deposit paid, minus a £250 administration fee.

Cancellations made 3–7 days before the scheduled start date will forfeit 50% of the deposit.

Cancellations made less than 3 days before the scheduled start date will forfeit the full deposit. This reflects the cost of reserved labour and equipment.

5. Access & Site Conditions

The client is responsible for ensuring safe and unobstructed access to the work area. This includes:

• Clear access to the roof or anchorage points
• Removal of obstacles that may impede rope access operations
• Notification of known hazards (asbestos, electrical cables, fragile surfaces)
• Secure parking for our vehicle within 50 metres of the site

6. Weather & Postponement

Rope access work is weather-dependent. We will not commence or continue work if wind speeds exceed 17 mph (Beaufort Force 4), during electrical storms, or in icy conditions that compromise rope integrity. We will reschedule at no additional cost. The client remains liable for any non-refundable third-party costs (permits, ferry crossings, etc.).

7. Insurance & Liability

We hold £10 million public liability insurance and £5 million employer liability insurance. Certificates of insurance are available on request.

Our liability is limited to the value of the contract. We are not liable for consequential loss, loss of profit, or indirect damages.

Clients must inform us of any shared or party walls, listed building status, or conservation area restrictions before work commences. We are not liable for costs arising from failure to disclose such information.

8. Guarantees

All workmanship is guaranteed for 10 years from the date of completion. This guarantee covers defects arising from faulty workmanship or materials supplied by us. It does not cover:

• Damage caused by subsequent building movement, settlement, or subsidence
• Damage caused by weather events exceeding design parameters
• Alterations or repairs carried out by third parties
• Normal wear and tear

9. Health & Safety

All work is carried out in accordance with the Work at Height Regulations 2005, IRATA International Code of Practice, and relevant British Standards. A method statement and risk assessment will be provided for every project. The client must ensure that all occupants and visitors are informed of the works and restricted from the work area.

10. Governing Law

These terms are governed by the laws of Scotland. Any dispute shall be subject to the exclusive jurisdiction of the Scottish courts.
